Parliament: Karpal says Lingam case should not be closed
KUALA LUMPUR: A veteran MP has asked the Attorney-General to keep the Datuk V. K. Lingam case in connection with brokering of judges appointment open.
Karpal Singh (DAP - Bukit Gelugor) said the investigation papers of the case could still be opened despite it was given the classification of no further action.
“This is not absolute. The investigation paper can be re-opened. The AG should reconsider its decision,” he told reporters at the Parliament Lobby Thursday.
He said Lingam’s words featured in the video clip has proven to be seditious. “This is tantamount to bringing disrepute to the judiciary. You don’t have to prove that he brokered the appointment of judges,” he said.
Earlier while debating the Judges’ Code of Ethics 2009, Karpal Singh said the AG should be brave to take action against anyone regardless of who the person is.
Calling Lingam a crook and not a prominent lawyer, Karpal Singh said the former appeared in court acting for former Prime Minister Tun Dr Mahathir Mohamad recently and told the court that:
“ I don’t have to act Bona fide (good faith). “Lingam is dangerous,” Karpal Singh said.
Opposition Leader Datuk Seri Anwar Ibrahim (PKR -Permatang Pauh) while debating on Judges’ Code of Ethics, said despite recommendation from the royal commission, all escaped facing the music.
“This is not rule of law. This is law of the jungle,” he said, adding that findings of the royal commission seemed to carry no weight.
It was reported that the case against Lingam in connection with the alleged brokering of judges, that was featured in a video clip, has been closed with no further action.
A Royal Commission of Inquiry was conducted in the Lingam video case which showed the prominent lawyer purportedly involved in brokering a deal that manipulated the appointment of judges.
The video implicated five people, including Lingam, former chief justices Tun Eusoff Chin and Tun Ahmad Fairuz Sheikh Abdul Halim, tycoon Tan Sri Vincent Tan and the then Deputy Minister in the Prime Minister’s Department Datuk Seri Tengku Adnan Tengku Mansor who was in charge of legal affair

1. The NST reported that the Lingam case is closed. He will not be persecuted (or prosecuted).
2. He must be feeling very relieved. But what about the Commission's report on his influence over me in the selection of judges?
3. I was waiting for my day in court so I can defend myself. I have a lot of things to say about attempts to influence me on the appointments of judges.
4. Now that Lingam has no case to answer, how does it affect my being accused of being influenced by him, remembering that the tape was about his alleged phone conversation with other individuals. Did he say that I asked him to speak to those people? Was my name involved in his phone call?
5. These questions will remain in the minds of the people who read the conclusion of the Commission. So what now?
6. For some time during the past regime I was told that a thorough search was made to find instances where I abused power or accepted illegal gratification while in office. Apparently nothing was found.
7. Could it be that one way of getting at me was to accuse me of being influenced by Lingam in my choice of judges?
