KUALA LUMPUR: Four former directors of a tech company once listed on Bursa Malaysia were charged with causing wrongful loss to its subsidiaries, amounting to RM5.1mil.
Datuk Yap Wee Hin, Law Siew Ngoh, Datuk Ng Back Heang and Robert Daniel Tan Kim Leng who were with Patimas Computers Berhad were charged under section 317A(1) of the Capital Markets and Services Act 2007 (CMSA) at the Jalan Duta Sessions Court here on Thursday.
They were allegedly charged with causing the four subsidiaries of the company to make payments to them for the purported development of various software.
The payments were, however, not used for such a purpose, resulting in losses to the subsidiaries.
They were each charged with committing 10 offences on three different dates in 2010.
All four of the accused pleaded not guilty to the charges.
This is the first time that the Securities Commission is taking criminal action under section 317A(1).
Judge Zaman Mohd Noor set bail at RM200,000 each with two sureties and ordered all four of them to surrender their passports to the court.
The accused said they would post the bail by Friday.
Case management has been set for Nov 1.
Mohd Hafiz Mohd Yusof and Munira Masood from the Securities Commission acted for the prosecution.
A breach of section 317A(1) of the CMSA carries a maximum of 10 years' jail and a fine not exceeding RM10mil upon conviction.

Patimas Computers Berhad was delisted from Bursa back in March 2014.
